Rules and regulations for community Associations are also established by
means of board resolutions. A resolution is a motion that follows a set
format and is formally adopted by the Board of Directors. Resolutions
may enact rules and regulations or formalize other types of Board
decisions. The power of the Board to enact rules and regulations is
generally defined in the Declaration and/or Bylaws of the association.
Senate Bill 100, signed into law by the Governor of the State of Colorado
on June 6, 2005, states that:
In addition to records specified in subsection (1) of this section, the
Association shall keep a copy of each of the following records at its principal office:
38-33.3-317(5)(e) Resolutions adopted by its (association) executive
board relating to the characteristics, qualifications, rights, limitations,
and obligations of unit owners or any class or category of unit Owners.
Resolutions are kept in Books of Resolutions at the Association's office.
While the Association has adopted many hundreds of Resolutions since
the founding of the Association in 1972, many of those Resolutions have
been rescinded, amended, revoked, or have been replaced over the
years. If you wish to review all Resolutions made since the inception of
the Association, those are available for your review in the Administrative
Office for the Association. In order for you to be better informed of the
Resolutions enacted by the Association, the following is a listing of all
Association Resolutions currently active.
